TERM AND CONDITIONS

INTRODUCTION

These Terms and Conditions govern the use of SHG Finance Plc services through the SHG Mobile Application (Terms and Conditions) provided to users of SHG Finance Plc Mobile Apps.

These Terms and Conditions do not represent any special conditions to access the Services contained in this Mobile Application. The services provided by SHG Finance Plc will be subject to additional terms and conditions in accordance with the applicable laws and regulations that require users to carefully read and review the terms of each specific service.

Users shall read and review these terms and conditions before starting to use this mobile application. In case the user does not agree to any terms, the user should cease to use this program immediately.

TECHNICAL TERMS AND DEFINITIONS

SHG mobile: An application developed by SHG Finance Plc to provide customers the digital credit platform and access to other transactions by mobile phones.

PIN: Personal Identification Number which is a 04-digits number combination selected by customer for using to access SHG mobile.

OTP: One Time Password is a 04-digits number provided by the system to fill in order to confirm access. OTP is used for only one transaction and will be expired in 60 seconds.

1. GENERAL CONDITIONS

These terms and conditions are an “Agreement” between you and SHG Finance Plc, with the purpose of using SHG mobile.

Before ticking “Agree” please cautiously read the Agreement. By ticking “Agree” on your mobile phone, you agree to all the terms and conditions provided in this Agreement and accept your responsibility in using SHG mobile.

Throughout this publication, the words “you”, “your” and “yours” refer to the account holder(s) in respect of the SHG mobile accounts accessible by using mobile phone while “we”, “us”, and “our” refer to SHG Finance Plc.

2. SHG MOBILE ACCOUNT CREATION
2.1.  ELIGIBILITY

  • Be adult of age 18 or above.
  • Have an iOS or Android or AppGallery mobile phone and a phone number.
  • Have a registered ZeePoin Account.
  • Be an employee under Z1 Group or related business partners.
  • Take a real selfie holding your Cambodia identity card, family book (In the case of a family head with a photo), family book or residence book (In case of family member, must be hold with other reliable documents with a photo and validity date such as ID card of government officer, working ID card, or passport (with at least 6 months’ validity).
  • Consent with terms and conditions of SHG mobile.

2.2. SHG MOBILE ACCOUNT REGISTRATION

You need to download SHG Mobile and install it on your phone, then click SHG Mobile to register by clicking on Ü Get Start button on SHG Mobile, fill in the information to create a user account and “Set PIN “

2.3. PIN SECURITY

  • You are required to create your own mobile PIN/Password consisting of 04-digits number.
  • Do not store the PIN anywhere, in written or electronic form; it must be memorized for convenient use.
  • Do not make or allow any person know your PIN; make sure no one watch while you are entering these codes.
  • You may need to change your PIN frequently.
  • Entering the PIN 5 times wrong, our system will block the use of your SHG mobile service automatically.

3. OUR PRODUCTS AND SERVICES
3.1. PRODUCT & SERVICE DESCRIPTION

3.2. CONDITION OF APPLYING LOAN

  • Comply with the conditions stated in point 2.1 on the right to use
  • Meet other special conditions required by us and the relevant regulations in force.

3.3. LOAN REPAYMENT & COMPENSATION

  • The loan payment is made automatically according to the payment schedule agreed in the mobile application, unless there is a request to adjust the principal installment different from the payment schedule or early loan repayment with the agreement of the users and us.
  • All your information such as account number, phone number and amount shall be accurate and clear and you shall check all the information on the mobile app before clicking “OK”.
  • You are solely responsible for any incorrect payments.
  • You agree to pay penalties as a result of any of your violations of the Mobile Application Operation.
  • We reserve the right at any time and without prior notice to deduct debts, payments, penalties and other fees that you owe SHG Finance Plc from your account.
  • In case the customer’s account is insufficient, we will inform you to deposit sufficient money in the account.

4. FEE CHARGE

In respect of using SHG mobile, you agree to pay the service fee set by SHG Finance and you hereby authorize us to deduct the service fee from your account balance without issuing prior notice.

5. ADITIONAL LINK

Our service may contain links to third- party websites or platform that are not owned or controlled by SHG Finance Plc. As being third-party links, we have no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party websites or platform.

You further acknowledge and agree that SHG Finance Plc shall not be responsible or liable, directly or indirectly, for any damage or loss caused or allegedly caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or platform.

6. YOUR LIABILITY

  • You shall be liable for any information registered the service via mobile phone by yourself and shall ensure that the information is accurate. If we found any of fake information given, you shall be responsible before the law.
  • You shall be responsible for any losses or damages including losses suffered by yourself, other persons or SHG Finance Plc. If you act or attempt to make transactions, invasion, searching, data cheating, fraudulence directly or indirectly, either alone or with any persons. You shall be responsible before the law whether you act intentionally or deliberately.
  • You agree to take every precaution to ensure the safety, security and integrity of your account and transactions when using SHG mobile.
  • You shall be very careful to ensure the safety of your operations when using this mobile app.
  • SHG Finance Plc may notify you within 30 days in the event of collection, payment, discontinuation, suspension, amendment, change of fees or any other matters relating to SHG Mobile. And your responsibilities through any of the following means:
  • Send notification SMS directly to your registered mobile phone
  • Send notification messages directly to your SHG Mobile account.
  • Notices are posted in our office and posted on our website.

7. TERMINATION OR CANCELLATION

  • You shall withdraw all your money or transfer out from your account before ceasing to use SHG mobile or terminating the service with us.
  • You may terminate SHG mobile by yourself on your registered mobile without being through our authorization.
  • You may also terminate SHG mobile at SHG Finance Plc’s office.

8. IP PROTECTION

  • All mobile app transactions are the intellectual property of SHG Finance Plc or its legal entities, including trademark, tradenames, logos, services, slogans and logos related to products, content, content formulas, images, patents or other objects are protected by the Law on Copyright and Related Rights of the Kingdom of Cambodia and / or international intellectual property conventions / conventions recognized by the Royal Government of Cambodia.
  • You are not authorized to use our proprietary rights except as permitted by the terms set forth in this Mobile Application.
  • You are not authorized to copy, sell, manage, lease, trade, license, renew or otherwise transfer ownership of our institution to any third party in an attempt to destroy, alter or disrupt our systems or software.

9. LIMITATION OF LIABILITY

  • To use this mobile app, you shall verify the information carefully and every press on the control button (mobile app tool) is at your own risk.
  • This mobile app is not intended to provide all kinds of advice. You should seek independent advice before activating and using this mobile app.

10. AMENDMENTS

We may update and modify the function or content of the mobile application at our discretion and we will issue notification. If you continue to use this mobile application, you are deemed to have acknowledged and agreed to be bound by the latest modification. If you do not agree to this modification, please stop using this mobile app.

11. DISPUTE RESOLUTION AND ADMINISTRATIVE LAW

The use of the mobile application and the implementation of these terms and conditions shall be governed by the laws of the Kingdom of Cambodia. If a dispute arises between you and us regarding any condition, first, parties shall try to have an understanding discussion in order to reach an appropriate and effective solution within 3 months. The parties shall negotiate and attempt to discuss with maximum patience to reconcile and adjust in a spirit of cooperation and friendship without turning to any third party. However, if the dispute between the parties is not resolved, either party may refer the case to the jurisdiction of the courts of the Kingdom of Cambodia.

12. THE AGREEMENT

All terms, conditions and obligations set forth in this policy are the entire agreement between SHG Finance Plc, our affiliates and you. Any prior agreement contrary to this agreement shall be null and void. In the event of any inconsistency between these conditions and any future conditions, the newly established terms or conditions shall prevail.
